Just because a DNS server replies with an MX record when asked for one is not soliciting random email. Not only that, but the RFC specifies that if a DNS server does not respond to an MX query, the mail server has to fall back onto the standard A record for the domain name in question. Is that solicitation?

Unsolicited email is mail that I receive but have not requested to receive. Especially when it contains advertisements. Just because I have a mail box, does not mean that someone can come by and just drop off 100's of pieces of mail, thereby clogging up my mail system.</description>
